Terms and Conditions of Use

1. Purpose and scope

These Terms and Conditions ("Terms") govern the access to and use of the IncepLine website and private online environment (the "Platform"). IncepLine operates as a private members' group providing information, tools and an organizational framework to users who independently manage their own financial or crypto portfolios. IncepLine is not a financial services provider and does not conduct brokerage, portfolio management, order execution, or fund reception activities. By accessing or using the Platform, you confirm that you have read, understood and agreed to these Terms.

2. Restricted access and VIP affiliation

Access to the Platform is strictly reserved for authorized private members. Membership is not automatic and may be granted, restricted or refused by the administrative service of IncepLine at its sole discretion. Certain sections, dashboards, documents or tools may be further restricted to VIP or higher-tier members. Any attempt to access the Platform without authorization, to bypass access controls, or to share access with third parties is strictly prohibited.

3. User account, login and password

Each member receives personal login credentials (username and password, and where applicable, additional security checks). These credentials are personal, confidential and non-transferable. The member undertakes to keep them secret and to implement reasonable security measures on his/her devices. Any action performed from a connected account shall be deemed to have been performed by the account holder. IncepLine makes every reasonable effort to ensure the protection of its members' data. However, the company cannot be held liable in the event of unauthorized access, data leaks, or fraudulent use resulting from the loss, negligence, disclosure, or insufficient protection of login credentials by the user or by the company itself.

4. Subscriptions, payments and related services

Access to certain areas of the Platform may be subject to a private or VIP subscription, payable in advance, according to the conditions communicated by IncepLine. Activation of services is carried out only after confirmation of payment. Unless otherwise stated, fees, activation costs and membership charges are non-refundable. IncepLine reserves the right to modify prices, plans or access levels; such changes will apply to new subscriptions or to renewals.

5. Individual responsibility for portfolio management

The Platform is designed for users who already manage, on their own, a financial, crypto or multi-asset portfolio. Each member remains fully and solely responsible for all operations, transfers, trades, payments, withdrawals and investments that he or she decides to perform, whether in fiat, by credit/debit card, via cryptocurrencies or via any other payment or custody channel. IncepLine does not validate, does not authorize and does not verify the profitability or appropriateness of the transactions made by members. No refund or compensation shall be due in case of error, wrong transfer, incorrect address, or inaccurate amount entered by the member.

6. No brokerage, no asset management, no refunds

IncepLine is a private online group, independent from any broker or financial institution. The Platform does not provide investment advice, does not execute orders on behalf of users, does not hold or receive funds on behalf of users, and does not manage assets for third parties. All information, content and tools made available are provided for informational and educational purposes only. Consequently, no refund, no chargeback and no compensation shall be granted on the basis of a performance expectation or a financial result not achieved by the member.

7. Intellectual property and use of tools

All content available on the Platform – including, without limitation, texts, structures, pages, scripts, style sheets, graphics, logos, icons, dashboards, internal tools and documents – is the exclusive property of IncepLine or is used under license. Any reproduction, copy, distribution, transmission, framing, or extraction of data, in whole or in part, without prior written authorization from IncepLine, is strictly prohibited. Access to the Platform does not grant any intellectual property rights to the user.

8. Security and protection of access

For security reasons, certain technical protections may be implemented (disabling right-click, restricting inspection tools, rate-limiting, IP checks, session expiration, etc.). The user undertakes not to attempt to deactivate, bypass or alter these measures. The user also undertakes to connect only from secure devices, to log out after each session and to notify IncepLine immediately in case of suspected compromise. IncepLine may, at any time and without notice, reinforce its security measures.

9. Anti-fraud, identity misuse and intrusion attempts

Any attempt to access another member's account, to impersonate another member or administrator, to inject malicious code, to scan the infrastructure, to mass-download internal data or to perform any action likely to compromise the integrity of the Platform is strictly prohibited and may lead to the immediate termination of access. IncepLine reserves the right to record connection data and to transmit all relevant information to the competent authorities in case of fraud, attempted fraud, identity theft or unlawful access. Administrative or legal action may be taken.

10. Technical failures and limitation of liability

The Platform is provided on an "as is" and "as available" basis. Interruptions, slowdowns, bugs, maintenance operations, updates or failures of the hosting provider may occur. IncepLine shall not be held liable for service interruptions, loss of accessibility, data unavailability or any indirect consequences that may result from them. The user acknowledges that the availability of the site depends in part on third-party providers (hosting, network, DNS) and that IncepLine has no control over all layers of the infrastructure. Under no circumstances shall IncepLine be held responsible for financial losses incurred by a member during such periods of unavailability.

11. Early release of funds and processing fees

Funds held in members' wallets can be withdrawn at any time. When requesting a withdrawal, if the threshold has not been reached, the member may request an early release of funds directly from their back office. Any early release entails non-refundable processing fees with a minimum amount of $75, plus 1% of the amount to be released. These fees are payable in advance, and the request will only be processed after full payment has been received. Depending on the frequency, context, or amount of the release, IncepLine may, at its discretion, require identity verification (KYC) or any other supporting document before execution. If the member refuses or fails to provide the requested documents, the operation will not be carried out and the processing fees will remain due to IncepLine.

12. Personal data protection (GDPR)

IncepLine processes personal data in accordance with the applicable European data protection rules (GDPR), for legitimate and declared purposes such as access management, security, invoicing and communication with members. Users may exercise their rights of access, rectification and deletion by contacting the data controller (Franck Martin). 13. Cookies and tracking technologies

The Platform may use cookies or equivalent technologies for authentication, security, audience measurement or service optimization. Non-essential cookies are placed only after consent, when required. The user may refuse certain cookies, but is informed that doing so may limit access to certain private features.

14. Service availability, maintenance and updates

IncepLine may temporarily suspend all or part of the Platform, in particular for maintenance, security updates, evolution of content, or correction of anomalies. Where possible, such interruptions will be scheduled at times of low activity. The user acknowledges that no compensation shall be due for such interruptions and that the content of the Platform may evolve at any time.

15. Financial liability and absence of performance guarantee

All decisions to invest, trade, buy, sell, transfer or convert assets are taken by the user alone and under his/her sole responsibility. Past performance, internal dashboards, scenarios, signals or examples provided on the Platform do not constitute a promise of results or future performance. IncepLine shall not, in any case, be held liable for losses, loss of opportunity, missed gain, volatility or any consequence arising from the user's operations, even when the user has made use of information or tools available on the Platform.

16. Suspension, deactivation or termination of access

IncepLine reserves the right to suspend or terminate, without prior notice, the access of any user who violates these Terms, attempts to compromise the security of the Platform, misuses the information made available, performs fraudulent actions or harms the image of the group. In the event of termination for breach, no refund shall be made for the remaining subscription period.

17. Changes to these Terms

IncepLine may amend or update these Terms at any time, in particular to reflect legal changes, security requirements or evolutions of the services offered. The latest version is the one published on the site. Continued use of the Platform after such changes shall constitute acceptance of the amended Terms.

18. Governing law and jurisdiction

These Terms are governed by and construed in accordance with French law. In the absence of an amicable settlement, any dispute relating to the interpretation or performance of these Terms and Conditions shall be subject to the exclusive jurisdiction of the French courts in Aix-en-Provence.
